Porn Link does not create dilution claim

Georgia federal court dismissed a trademark dilution claim brought by trademark holder against a licensee who included a link to a pornographic site on its website. The court noted that a plaintiff cannot base a tarnishment claim on the use of a mark on a site that links to another. Case name is Voice-Tel Enterprises Inc. v. Joba Inc. d/b/a Voice-Tel of South Florida. [BNA's Electronic Commerce & Law Report]
