3-ton Swan not protected under VARA

Judge Wexler ruled that plaintiff's 6,000 pound swan sculpture was not of "recognized stature" to be protected from destruction under Visual Artists Rights Act. The fact that plaintiff Linda Scott had "some level of local notoriety" wasn't enough to "afford VARA protection to each and every work she creates." Scott v. Dixon (EDNY 2004).
