How to defend domain name disputes

Circa 2002, I published an article in the CARDOZO ONLINE JOURNAL OF CONFLICT RESOLUTION, discussing the recently enacted Anticybersquatting Consumer Protection Act and the ICANN anticybersquatting domain name arbitration proceedings; as well as background cases relating to both the Lanham Act and the Federal Trademark Dilution Act, entitled The Young Cybersquatter's Handbook.

The article's title was a twist on The Young Poisoner's Handbook which I'm guessing was a twist on The Anarchist's Cookbook.

Anyway, the Young Cybersquatter's Handbook doesn't tell you how to cybersquat, but rather attempts to educate domain name registrants on how to avoid having to defend oneself from such actions. Regardless of that attempt, if you do ultimately find yourself in that position, i.e. receiving a "carefully worded letter" from a complainant, and you feel that you have indeed registered the domain in good faith, then you should consider contacting an attorney to help you further understand your rights.

Read the Young Cybersquatter's Handbook.
