You've Hijacked My Content

Evan Schaeffer, at Legal Underground, offers us two interesting thursday morning copyright related posts.

The first - Was This Law-Student Weblogger Caught Stealing? - deals with whether a law student can blockquote entire newspaper articles with accreditation to the newspaper without incurring the wrath of the content publishers? Apparently not. The Kingsport Times thought he was violating their copy rights and I'd have to agree. Interesting sidenote to this post, did you know Evan was a Jane's fan?

The second and more interesting, since it deals with the re-distribution of podcasts (originally distributed via RSS) - Are the Poachers Stealing from Me Too? - deals with whether PodRazor can advertise alongside other people's podcasts which they harvest and accredit.

This issue, which similar to Marty Schwimmer's issues with bloglines. Publishers clearly have copy rights under Sec. 107 with regard to the rss feeds, podcasts and blogs. The question is simply how do you enforce your rights. One way, as Evan and Marty have demonstrated, is to post about it. Podrazor had ads last night. But it seems that they may have already taken them down this morning. [see here] I'll continue to monitor the situation.
