Well this sucks.

Evan Schaeffer was a major contributor to Blawg Review; having done both the first post and one of the best to kick off 2006.

Anyway, I just wanted to publicly express my thanks to him for all of his efforts over the past year.

Law Student at the forefront of rootkit battle

via Boing Boing: "Mark Lyon, the law student who runs SonySuit.com (a clearinghouse for information about the lawsuits arising from Sony's practice of putting malicious spyware and rootkits on its music CDs) has filed a personal small claim against Sony for the damage done to his PC when he played one of the company's audio discs."

Telcos Two Tier Internet Plan

WFMU's Beware of the Blog is not happy about the two tiered internet system that the WSJ reported on today:

Telecom companies hope to charge Google, Vonage and other Web firms for delivery of music and movies over their networks, setting the stage for a big battle. Google and Yahoo plan to increase their offerings to mobile phones. 2:18 p.m.

Blawg Review, my how you've grown

While Blawg Review technically does not celebrate its 1 year anniversary until April 11, 2005; it had its beginnings with techlawadvisor's Belly Up to the Bar #1 published on January 5, 2005.

Bruce MacEwen of Adam Smith, Esq. is hosting Blawg Review #39 which will be published on monday January 9, 2006. Get your Blawg Review submissions in today.

It looks like there are dates available starting in late July 2006.

I secured the May 22, 2006 spot to commemorate my 5 years of blogging.

10 New Year's Resolutions for Bloggers Update

I have made attempts at Resolutions 1, 2, 4, 5, 6, and 7 from Evan Schaeffer's Blawg Review #38 so far this year.

I fulfilled Resolution 9 (Don't Let Your Weblog Make You Crazy) last year and #10 (learning from other blogs) is an ongoing process.

I also hope to follow the advice of Evan re Resolution 8 (Experiment with New Weblogging Ideas) in the upcoming weeks. Stay tuned.

Blawger Anonymity Not Allowed?

I just don't care very much for the tone of this post.

I don't even know why the post bothers me this much -- I've been emailing with the anonymous editor of Blawg Review, a site on which I am a contributing editor, for over a year without hesitation or asking that Ed. be outed. I mean I ask Evan Schaeffer every so often to confirm that it's not him but otherwise...

KLexblog: if you are not interested in responding to emails from anonymous readers of your blog, who have blogs or blawgs, then tell them so. Does the fact that Blawg Review is gaining momentum somehow threaten your business model? What's the deal? I've even opened my comments for you.

Disclosure: I'm not Ed.

Update: Apparently I've broken my comments and I apologize for that. BRANDY!!!

Wonkette & WSJ

CoxThe Wall Street Journal Online's new law blog -- written by Peter Lattman, a former Forbes magazine writer and previously a New York litigator -- has launched: "Queen of the blogosphere Ana Marie Cox is said to be handing over the reins at her spicy political blog Wonkette. David Lat, the federal prosecutor who revealed himself to the New Yorker magazine in November as the author of the popular "Underneath Their Robes" judicial blog, is expected to start blogging for the site."

Update: Also, please note that my half of my 2006 predictions has sorta just happened.

Another Update: WaPo confirms that Ana Marie Cox[/Wonkette/Gawker Media] is turning her blog over to lawyer David Lat[aka A3G].

Columbia Law Library Music Plagiarism Project

TLA 8-16-02: Here is a link to The Columbia Law School Music Copyright Infringement Online Archive, which analyzes more than 100 music federal copyright infringement cases from over the last hundred (and also contains audio samples and commentary).

NYT 12-31-05:

The Columbia Law Library Music Plagiarism Project features audio samples that compare songs that were involved in landmark copyright cases. Users can compare, for example, Gilbert O'Sullivan's "Alone Again (Naturally)" with "Alone Again" by the rapper Biz Markie, which sampled the original and lifted the lyrics.

The site includes court decisions and commentary on them from the site's authors. The judge in the "Alone Again" case, the site says, missed the fact that "apart from the gibberish chanted over O'Sullivan's ostinato, there is nothing original in Biz Markie's song or his recording except his performance of it."

Other songs featured on the site include "Don't Fence Me In," "Feelings" and John Lee Hooker's "Boogie Chillun.'" For some mysterious reason, the sound files are all encoded in the RealPlayer format.

Coldplay Shrinkwraps DRM Message

Just passing this information along regarding the DRM of the new coldplay album: "Except for manufacturing problems, we do not accept product exchange, return or refund." [via boing boing] I'm interested in hearing from anyone who in fact does attempt to return it whether the record store attemtpts to enforce the terms of the shrikwrap contract.

One prediction for 2006

NYT and WSJ will continue battle to be pre-eminent paper to report on blogs. NYT will turn nyt.com into a blog.

Update on 1/4/06: So I basically nailed this prediction right? WSJ.com has joined the blawgosphere and the NYT now links to related blog posts. [via Ann Althouse]

New Year, New Laws

Some new internet regulating laws taking 'ffect in California in a few hours PST [via].

INTERNET HUNTING: Prohibits use of Internet sites designed to allow people to shoot at animals via a Web link.

PHISHING: Makes it illegal to solicit or request someone's identifying information by falsely representing that the information is being requested by a business, a practice known as "phishing."

CAMPAIGN MESSAGES: Prohibits candidates from using text messaging to transmit campaign ads.
