Target suing Blogger for posting anti-theft policy

MSNBC via TVC is reporting that Target Corp. has filed a lawsuit in federal court in Atlanta on September 5, 2006 for posting Target's anti-theft procedures on targetunion.org.

MSNBC interviewed David Bodney, a First Amendment and media rights lawyer with Phoenix-based Steptoe & Johnson LLP, who indicates that if the John Doe blogger never signed a confidentiality decree, then "Target would have to prove the poster knew the policy was confidential" and that "the postings had no legitimate purpose other than to malign."

According to the anonymous poster in question "Target Sucks" on July 28, 2006, Target's law firm Faegre & Benson was monitoring (pdf) the site for improper activity.

Beta Blogger Better

Of course I have some issues with the new Blogger in Beta, but once they get the template kinks worked out, it will provide a nice new platform for bloggers. Not as robust a platform as what the new Blawgr is built on, but for those persons who continue the need to blog from a non-community based platform it offers several upgrades over the current Blogger platform.

The important upgrades include privacy settings for site and rss feeds, easier template manipulation for the HTML-illiterate, Categories - known as Labels is Google land, and the fact that blogger is now dynamically serving content which makes publishing a snap.

The template kink I referred to above is the inability to both edit the HTML and use the new wysiwyg template editor which work with the upgraded template designs and categories.

Comment Liability

A recent decision in a Section 230 (of the Communications Decency Act) case probably means that "web publishers cannot be sued for libel on the basis of anonymous comments posted on their websites."

How to Unmask an Anonymous Blogger

Kevin F. Berry, chair of the commercial litigation practice group at Cozen O'Connor, penned this article, How to Unmask an Anonymous Blogger, for The Corporate Counselor discussing when "does it make sense to spend the time and expense necessary to determine the identity of an anonymous blogger who is damaging the company?"

Also, provides a look at a number of related cases.

Lawyers and blogging go together like witches and stoning

Cameron Stracher in today's WSJ ($): "According to a survey conducted by blogads.com, lawyers ranked fourth among both readers and posters to blogs. Many of the best- known blogs, such as instapundit.com, are run by lawyers. It's easy to understand why blogging attracts the J.D. set: Few professions combine as much creative talent with so much mind-numbing work."

Also discusses Wonkette, Opinionistas lawyers turned fiction writers and recommends that a happy lawyer should start a blog about their work.

Big Law Laying Claim to Blawging

Kevin O'Keefe has posted details on his site on the Blog Law & Blogging for Lawyers Conference which includes several interesting panel discussions and speakers from firms such as Wilson Sonsini, Davis Wright Tremaine, and McGlinchey Stafford.

Dennis Crouch of Patently-O is one of the co-chairs with Cathy Kirkman and O'Keefe is even doing a panel on blawging * (note though that he posts the title of his workshop on his blog as "Business of Blogging for Lawyers").

I coulda been anonymous

I realize that my two worst mistakes in starting this blog while I was an associate at a NYC trademark litigation firm was:

1. 2002 was too early to start blogging - late 2004 or early 2005 was definitely the time to start and
2. I should've maintained it anonymously.

Oh well.
